How to give notice on your rental?
As a tenant, you can leave your rental at any time by giving notice. For an unfurnished rental, the notice is normally 3 months. It is reduced to 1 month when the property is in a rent-controlled zone or for certain reasons (job transfer, job loss, first employment, RSA or AAH beneficiary). For a furnished rental or a mobility lease, the notice is 1 month.
The termination letter must be sent to the landlord by registered mail with acknowledgement of receipt, handed over against a receipt, or served by a judicial commissioner (art. 15-I of the law of 6 July 1989). The notice period starts on the day the landlord receives the letter.
At the end of the lease, a move-out condition report is carried out and the security deposit must be returned within two months at most (or one month if the move-out report matches the move-in one), otherwise a penalty of 10% of the monthly rent per month of delay applies (art. 22).
