The condition report: what the law says
The condition report (état des lieux) is a document that precisely describes the state of the property, room by room, when the tenant moves in and again when they move out. It is governed by article 3-2 of law no. 89-462 of 6 July 1989 and its contents are set by decree no. 2016-382 of 30 March 2016.
It is drawn up jointly and amicably by the parties (or by an authorised third party) when the keys are handed over and returned. Comparing the move-in and move-out reports determines any repairs chargeable to the tenant and any deductions from the security deposit.
This generator produces a blank template ready to fill in and sign. The details you enter are neither stored nor shared. Remember to record the meters (water, electricity, gas) and to attach the furniture inventory for a furnished letting.
Frequently asked questions
Is this condition report template legally compliant?
Yes. The document follows the structure required by decree no. 2016-382 of 30 March 2016: room-by-room description, meter readings, condition of surfaces and fittings, and signatures of both parties.
Is this generator really free and account-free?
Yes. You fill in the form, the PDF is generated instantly and no data is stored on our servers. No sign-up is required.
What is the difference between the move-in and move-out reports?
The move-in report is done when the keys are handed over and describes the property at the start of the tenancy. The move-out report is done when the keys are returned: comparing it with the move-in report determines any damage chargeable to the tenant.
What happens if there is no condition report?
Without a move-in report, the tenant is in principle presumed to have received the property in good repair (article 1731 of the Civil Code). However, the party who prevented the report from being drawn up cannot rely on this presumption (article 3-2 of the 1989 Act): a landlord who made no report may therefore be unable to withhold anything. It is essential to draw up a joint report signed by both parties.
